Rules, payments, and our service boundaries.

Welcome to Serverfy. By registering for an account and using our services at serverfy.io ("Service"), you agree to be bound by these Terms of Service ("Terms") established by Braveware T. I. Ltda ("Serverfy", "we", "us", or "our"). If you do not agree to these Terms, do not use our Service.

1. Description of Service

Serverfy is a software-as-a-service (SaaS) control panel designed to provision, manage, and deploy applications to third-party virtual private servers (VPS). Serverfy is not a hosting provider. You are required to maintain and pay for your own accounts with cloud infrastructure providers (e.g., DigitalOcean, AWS, Hetzner, Vultr).

2. Fair Use of Unlimited Resources

Features labeled as "unlimited" (including but not limited to sites, deployments, and database creations) are subject to a Fair Use Policy. These resources are intended for standard business or personal usage. Serverfy reserves the right to rate-limit, suspend, or terminate accounts that generate an unreasonable load on our infrastructure, utilize automated scripts for abusive mass-deployments, or otherwise degrade the performance of the service for other users. We alone will determine what constitutes abuse or unreasonable usage.

3. Third-Party Infrastructure and Services

Serverfy acts strictly as a management layer. We do not own or control the underlying cloud hosting providers or version control systems (e.g., GitHub, GitLab). We are not responsible or liable for any outages, data loss, API rate limits, or breaches that occur at these third-party providers. Any fees billed by your cloud providers are solely your responsibility. If a third-party service modifies its API or revokes Serverfy's access, we are not liable for the resulting interruption of your deployments or monitoring.

4. Manual Server Interference and Support

Serverfy automates the installation and configuration of software on your servers. If you or your team manually SSH into a managed server and alter core configuration files (including but not limited to Nginx, PHP-FPM, MySQL, or UFW rules), you do so at your own risk. Serverfy is not responsible for restoring functionality, fixing downtime, or providing technical support for servers that have been manually misconfigured or corrupted by the user.

5. Security and Vulnerability Testing

You may not perform security, vulnerability, load, or penetration testing against the Serverfy dashboard, API, or infrastructure without our express prior written consent. You may test the applications hosted on your own managed servers, provided such tests do not negatively impact the Serverfy management daemon or network.

6. Payments, Cancellations, and Refunds

  • Billing: Services are billed in advance on a subscription basis.
  • Cancellations: You may cancel your account at any time. Upon cancellation, Serverfy will permanently delete its access keys from our database. Your servers will remain online and untouched at your cloud provider.
  • Refunds: Because we offer transparent pricing and the ability to cancel at any time, we do not offer refunds for partial billing periods.

7. Limitation of Liability and "As Is" Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. IN NO EVENT SHALL SERVERFY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, SERVER DOWNTIME, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts located in São Paulo, State of São Paulo, Brazil.

9. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or through a prominent notice on our dashboard. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
